Terms of Service

1. Identification

This site is published by Anthony Chavez, founder of ACiD Studio, an independent service provider.

2. Purpose

These General Terms (Terms of Use / Terms of Sale) govern the use of the acidstudio.ch website as well as the contractual relationship between ACiD Studio (the "Provider") and any natural or legal person (the "Client") ordering a service through the site, the purchase funnel, or a custom quote.

3. Services Offered

ACiD Studio offers three main packages:

  • Express — Showcase website delivered within 48 business hours.
  • Pro — Web application over 7 business days (authentication, dashboard, payments, etc.).
  • Prestige — Bespoke project, custom quote with a schedule defined in advance.

The details (deliverables, technologies, options) are specified in the quote sent before signature. See detailed comparison of the packages.

4. Order and Formation of the Contract

Every order is preceded by a quote sent by email after discussion (contact form or purchase funnel). The contract is formed upon the electronic signature of the quote by the Client (express acceptance via the portal or the link provided).

For direct purchases via the funnel (creer-mon-site), the order is validated upon receipt of the Stripe payment.

5. Pricing and Payment

  • Express: fixed price announced on /tarifs-details, payable in full at the time of order.
  • Pro: 30% on signature of the quote, 70% on delivery.
  • Prestige: terms defined in the custom quote (typically 30/30/40 or staged by milestones).

Payments are processed by Stripe (bank cards) or by bank transfer (TWINT, Swiss IBAN provided on request). Any invoice unpaid at its due date may give rise to default interest (5% per year, art. 104 of the Swiss Code of Obligations).

6. Delivery Times

Delivery times run from the receipt of the initial payment (or the deposit) AND of all the content / access required from the Client (texts, images, domain, third-party accounts). Any delay attributable to the Client suspends the delivery times without penalty for the Provider.

7. Hosting, Domain, and Ownership

  • Unless a specific option applies, hosting is provided with Infomaniak (Switzerland) in the Client's name. Hosting and domain name fees are borne by the Client.
  • Upon delivery and full payment, the Client becomes the full owner of the delivered code, the access credentials, and the content produced.
  • ACiD Studio reserves the right to mention the project in its portfolio (unless the Client objects in writing).

8. Warranty and Corrections

A warranty period of 30 days from delivery covers the correction of functional bugs (as defined in the quote). Enhancements or new features are subject to a separate quote.

9. Subscriptions (recurring packages)

Some packages include a monthly subscription (managed hosting, support, updates). Subscriptions renew automatically each month via Stripe and may be cancelled at any time from the client portal, without notice. Cancellation takes effect at the end of the current period (no pro-rata refund).

Complimentary design and commitment. Where the package includes a complimentary design (creation fees normally invoiced at 3,999 CHF, deducted at 100%), the subscription is subject to an initial commitment of twelve (12) months. In the event of cancellation before this term, the design fees become payable pro rata to the remaining months of commitment. After the twelve months, the subscription becomes cancellable at any time under the conditions above.

10. Right of Withdrawal

In accordance with Swiss law, there is no general right of withdrawal for services ordered online by a professional (B2B). For consumers (B2C), a termination may be negotiated amicably, but work already undertaken remains due on a pro-rata basis.

11. Intellectual Property of the acidstudio.ch website

The trademarks, logos, texts, images, videos, and source code published on acidstudio.ch are protected by Swiss copyright law (art. 2 of the Swiss Copyright Act). Any reproduction, representation, or redistribution without prior authorization is prohibited.

12. Liability

ACiD Studio acts exclusively as a technical service provider. We are not a party to the commercial relationships, transactions, or payments occurring between Clients (owners of the delivered sites) and their own end users. Our liability cannot be engaged for any dispute relating to transactions carried out on the third-party sites we have designed.

The Provider does not guarantee the absence of errors, viruses, or interruption of access to the site, and cannot be held liable for any direct or indirect damage resulting from its use, except in cases of proven fault.

13. Personal Data

The processing of personal data is governed by our Privacy Policy (compliant with the Swiss FADP (nLPD) + GDPR).

14. Hyperlinks

The site may contain links to third-party sites. ACiD Studio has no control over these sites and cannot be held responsible for their content or their availability.

15. Governing Law and Jurisdiction

These terms are governed by Swiss law. In the event of a dispute, and after an attempt at amicable resolution through written exchange, the courts of the canton of Vaud (Switzerland) shall have sole jurisdiction.

16. Amendments

ACiD Studio reserves the right to amend these terms at any time. The applicable version is the one in force on the date the quote is signed. For users of the site with no contractual relationship, the published version prevails.
